The contract of purchase, due to which the purchase from seller to customer is executed, is valid by the moment of completing the order by the buyer. A confirmed order by the seller is a binding agreement for both parties, if the terms&conditions are not violated at the time of confirmation of the order. Considered as important terms are mainly the content of the order (quantity and specification of the goods), the price of the ordered goods at the ordered time and the shipping method. We are not payers of VAT, therefore all prices are final.

Goods, which have been purchased on baybayofficial.com or baybay.sk can be returned within 14 days of receiving them. Please just inform us by e-mail to reklamacie@baybay.sk about your return and attach the invoice of your purchase (you receive this by e-mail after purchase). It is necessary to return the goods as a secured shipping (we can not take financial responsibility for lost packages by delivery services) and not as “Cash On Delivery” mail – these will not be accepted. Your money will be send back to your bank account after we receive the products in former condition to the address: baybay, Brigadnicka 27, 84110, Bratislava, Slovakia. The fees incurred with returning the goods are paid by the buyer. The goods have to be in former condition, which means unused/unworn, undamaged, with all tags if they were attached and packed properly.  We will refund your payment on your bank account or in any other requested refund form.

In cases of reclamations baybay has the right to decide within 21 days if the reclamation is accepted, or if the damage incurred by inappropriate manipulation of the buyer and isn’t accepted.

Cancelation of orders by buyers:

In case of order cancellation the buyer, the buyer is obligated to refund all costs (incurred damage) by doing so. The seller preserves his right to refund incurred damage/costs, mainly in the case of „backorders“, in which case the goods had to be reordered on the customers/buyers request or in the case there have been expenses incurred. The cancellation fee may be up to 50% of the whole order price.

Cancellation of orders by the seller:

The seller preserves his right to cancel orders or part of the order in this cases:

the ordered items are no longer being produced or delivered or the price of the requested goods has expressively changed, if it is not possible to contact the supplier (in case of wrong contact details, phone switched off or if the supplier is not answering to e-mails, letters..). In these cases, the seller will contact the buyer in order to make an aggreement on further steps. If the buyer has already paid for his order, the paid amount will be refunded on his bank account or to his hands within 15 working days.

The delivery of the subject to the contract (ordered goods) will be processed as soon as possible, depending upon accessability of the goods and operational options. The seller does not engage to the delivery duration written in the shipping terms, as the delivery of goods also depends on the supplier as third parties.

On every sold goods there is a 24 months guarantee starting with the date of purchase, due to law restrictions. The seller is forced to come to an decision in case of reclamation and this within 30 days of receiving the reclamation and items. The quarantee can not be applied on goods which have been physically damaged, or has been damaged by inappropriate handling of the buyer.

The seller delivers the ordered goods via Slovak Mail or GLS courier service. The seller is not responsible for belated delivery of the goods by Slovak Mail or GLS, or by the customer giving inaccurate or incomplete or incorrect personal information. The buyer is engaged to review his order when delivered by courier or Slovak Mail and to confirm the delivery by signing the delivery file.

If the buyer has choosen COD (cash on delivery) as the payment method and he is not able or refuses to pick up the delivery, and this for any reason, the buyer is obligated to refund the incurred costs (shipping and packing costs). In case that the buyer asks for repeated delivery of the ordered goods, the order will be shipped to the customer again with a doubled shipping and packing fee. In case that the buyer is no longer interested in receiving the order, the seller has the right to act as in „2. Cancellation of orders by buyer“. In repeated cases of the customer not picking up orders the seller preserves his right to add behindhand fees for orders and in the case that the customer repeatedly does not pick up his/her order for the 3rd time, baybay preserves the right to put the customer on the so called „Blacklist“ and has the right to refuse further orders of this customer.

The abandonment of the contract is not possible in cases when the goods have been damaged or grimed, the goods have been used or bear signs of usage, the last protection foil has been removed (the goods have been unpacked completely), the goods have been ordered for the customer on special request (goods which are usually not on stock).
